As part of a planned expansion into medical criminal law, Archbold Hong Kong 2025 chapter on Public Health now covers offences related to medical practice.
In recent years, criminal offences concerning medical practices frequently made it into the public spotlight. These cover licensed and unlicensed medicine practices concerning a broad scope of activities. On the other hand, the regulation of the healthcare system in Hong Kong saw major revisions with the introduction of the Private Healthcare Facilities Ordinance (Cap 633) in late 2018, which is still being phased into operation.
Against this background, the Archbold Hong Kong chapter on Public Health is set to expand into the complicated area of medical criminal law. The first new area covered in the 2025 edition is the little-known but frequently prosecuted offences under the Hospital Authority Bylaws (Cap 113A), which regulates conduct on the premises of public hospitals and clinics under the HA. Second, is the new regulatory regime and offences under the Private Healthcare Facilities Ordinance.
This is only the first wave of expansion. Other crucial topics are being planned for future publication of supplements and main works.
